Declaration
This declaration serves as basis for fair and ethically justifiable practices in the international recruitment, placement, and employment of foreign personnel intended for deployment in the German health care system: Globogate will keep this foundation and is concerned that all its business partners will follow this basis.
This declaration is based in principle on the recognition of the WHO Global Code of Practice for the International Recruitment of Health Personnel, which – besides the compliance with the International Convention on Human Rights – is the supreme guideline for collaboration among the business partners. It especially serves to protect the right of the individual to migrate and the understanding that the legitimate interests and responsibilities of healthcare professionals in the country of origin and of the employers in the country of destination do not come into conflict.
GLOBOGATE and its business partners undertake voluntarily to observe the ILO Core Labor Standards, especially the General Principles and Operative Guidelines for a fair recruitment of ILO and the IRIS-Standards of the International Organization of Migration.
This essentially results in the following principles, which must be taken into account in the context of recruiting employees from abroad.
- Respect for laws, fundamental principles, and rights in the workplace.
- Respect for ethical and professional conduct.
- Prohibition of recruitment fees and related costs for foreign employees.
- Respect for freedom of movement/freedom of movement of persons.
- Respect for transparency concerning the conditions of employment.
- Respect for confidentiality and data protection.
- Preservation of access to legal remedies.
- In addition, business partners shall observe that the recruitment and placement processes comply with the laws and agreements of all participating countries in which they operate, including relevant labor and immigration laws.
Since GLOBOGATE will act on behalf of customers and implement the service packages with business partners commissioned by it that submit to this declaration, GLOBOGATE, as far as practicable, will verify if the goals, motivations, contractually targeted obligations, and practices of all parties comply with this declaration.
GLOBOGATE and its business partners follow a strict “No Fee Policy” for foreign employees, respectively the principle of „Employer pays“.
Furthermore, GLOBOGATE and its business partners confirm the following:
Foreign employees have the right to be recruited for work in Germany through a process that will be based on a fair and transparent recruitment process, an appropriate working environment, and recruitment conditions that meet the assurances given.
The employees have the same right and responsibilities as their colleagues in Germany and are responsible to their recruiter and/or employer for the fulfillment of their duties.
GLOBOGATE and its business partners confirm that no reprisals will be taken against persons who file a complaint or report a suspected violation of this declaration. GLOBOGATE and its business partners take disciplinary actions against staff or other parties who violate this principle. This may include (without being limited to it) that the violation – if required by law, agreement, or contract – is disclosed to public officials and that, if necessary, contractual relationships with the party concerned are not entered into or terminated.
